Section references below refer to Program Regulations, Article 6 of Division 13 of Title 4 of the California Code of Regulations.

Reference to the IOUs refers to the four Investor-Owned Utilities in California: Pacific Gas and Electric Company, San Diego Gas & Electric Company, Southern California Edison Company, and Southern California Gas Company.

Pursuant to Section 10092.4, by signing below,

Acknowledges that:

Its representatives and agents are not employees of CAEATFA or any of the participating IOUs, and must not represent themselves as such;
CAEATFA and the State of California will have no liability to the Eligible Contractor or Eligible Project Developer under the Program; and
The IOUs are not responsible for, and will have no liability for:

The energy efficiency improvements funded through the Enrolled Financing Agreements supported through the Loss Reserve Accounts;
The assessment of potential benefits and costs associated with those improvements;
The selection of Eligible Contractors and Eligible Project Developers;
The Eligible Contractor’s or Eligible Project Developer’s marketing policies and practices; and
CAEATFA’s educational and outreach activities.

Certifies that, as a Participating Contractor or Participating Project Developer, the entity:

Is responsible for identifying and making all disclosures required under applicable laws;
Must comply with all applicable laws and tariffs, possess and maintain all required state licenses, and remain in good standing with all governmental authorities having jurisdiction over its business;
Must follow Program rules as set forth in Program regulations including, but not limited to, the Project requirements set forth in Section 10092.7;
Must hold and maintain a commercial general liability insurance policy or policies of not less than $1 million per occurrence throughout its participation in the Program. The Eligible Contractor and Eligible Project Developer must submit proof of that insurance in its application to CAEATFA;
Must permit an audit, by CAEATFA, of any of its records relating to the Projects financed by Enrolled Financing Agreements during normal business hours on its premises, and must supply any other information relating to those projects as requested by CAEATFA;
Indemnifies and holds CAEATFA harmless from any and all damages resulting from its representations, savings estimates, sales, warranties, maintenance, any installed measure, product, and/or system, and service for all installed measures, products, and/or systems;
Must not make false or misleading claims about any part of the Program or its performance, including energy performance savings, or engage in fraudulent or deceitful conduct in the sale or installation of measures;
Has no outstanding judgments and/or liens; and
Agrees that its employees and representatives are solely responsible for all representations made to Eligible Commercial Financing Customers regarding the Program or work performed for an Eligible Commercial Financing Customer under the Program, and are responsible for all savings estimates, sales, warranties, maintenance, and service for all products and systems installed.

The following Certification applies only to Project Developer applicants.

Certifies that, as a Participating Project Developer, for all forthcoming Projects that will be submitted for enrollment in the Program:

Any developer services costs will be for services related to the Project;
It will comply with all Program regulations, rules, and requirements;
The Project will comply with Program requirements; and
Any ESMs to be reported as self-installed will be installed and will comply with Program requirements.

Section 7: Optional Public Listing on the GoGreen Business Website and Program Materials

In order to publicize the company's listing as an Enrolled Contractor/Project Developer in the GoGreen Business Energy Financing Program, the company authorizes the California Alternative Energy and Advanced Transportation Financing Authority (CAEATFA), and its authorized agents and representatives, to use the company's logos, trade names, and trade-service marks, (collectively, “Logos”) on the program website as well as in other communication materials (such as print promotion and advertising) to further increase awareness of your company among potential customers, program participants, and stakeholders.

By signing below, you agree to provide CAEATFA with the company’s current Logos and with any subsequent changes and grants CAEATFA the use of its Logos for the purposes described above. Other than the rights granted here, CAEATFA acknowledges that it has no other rights in the company’s Logos.
